NOTICE OF FORECLOSURE SALE Freddy R. Gregg and Amelia E. Gregg conveyed to I. Dyke Tatum, as Trustee, real property in Hawkins County, Tennessee by Tennessee Deed of Trust, Security Agreement and Assignment of Rents and Leases dated September 30, 2008, recorded September 30, 2008 in Book 924, page 698 in the Register's Office of Hawkins County, Tennessee (the "Deed of Trust"), to secure payment and performance of the debt described in the Deed of Trust. U.S. Bank N.A. ("Bank"), as owner and holder of the indebtedness secured by the Deed of Trust, appointed Justin M. Sveadas as Substitute Trustee by Appointment of Substitute Trustee recorded in Book 1323, page 690 in said Register's Office, to have all rights, powers, privileges and immunities granted to the original Trustee in the Deed of Trust. Default has been made in the payment of the debt secured by the Deed of Trust. Bank has declared the entire balance due and payable and has instructed the Substitute Trustee to foreclose the Deed of Trust in accordance with its terms. NOW, THEREFORE, the Substitute Trustee, on Friday, December 27, commencing at 1:00 p.m. at the main entrance of the Hawkins County Courthouse in Rogersville, Tennessee, will offer for sale and sell at public auction to the highest and best bidder for cash the property therein conveyed, more particularly described as follows: Situate in the Fourth Civil District of Hawkins County, Tennessee, a short distance south of the corporate limits of the Town of Rogersville, Tennessee, and being more particularly described as follows: BEGINNING at an iron pin the westerly edge of State Highway 66, corner to Maple Drive, said Maple Drive leading into the Forest Hills Subdivision as shown in Map Book 8, page 105 in the Register's Office for Hawkins County, Tennessee, to which reference is hereby made; thence with said margin of Maple Drive S 75 10 W 198.9 feet to an iron pin, corner to Lot 25 of the said Forest Hills Subdivision; thence S 22 05 E 85.5 feet to an iron pin; thence S 29 58 E 161.5 feet to an iron pin; thence in a northeasterly direction 98.0 feet to an iron pin; thence northerly 20 feet to an iron pin; thence northeasterly 86 feet to an iron pin at the edge of State Highway No. 66; thence N 23 15 W 76 feet to an iron pin, the point of BEGINNING. Being the same premises conveyed to Freddy R. Gregg and wife, Amelia E. Gregg by deed of Jeannette A. Cagle, recorded in Book 924, page 696 in the Register's Office for Hawkins County, Tennessee. Said property is designated as Hawkins County Map Parcel Number 113L-C-017.00 and has a street address of 107 Forest Hills Loop, Rogersville, Tennessee 37857. However, the street address is not a part of the legal description herein. In the event of a discrepancy between the street address and the legal description, the legal description shall control. The sale shall be in bar of all rights and equities of redemption, statutory and otherwise, homestead, dower and all other rights or exemptions of every kind, all of which are expressly waived in the Deed of Trust, but subject to the following: (a) unpaid taxes against the property; (b) recorded easements, restrictions, conditions, covenants, rights-of-way or subdivision plats affecting the property; (c) dedication of roads affecting the property and applicable governmental zoning and subdivision ordinances and regulations, (d) prior or superior liens, judgments, deeds of trust or other interests of record; and (e) matters that an accurate survey of the property might disclose. Notice has been given pursuant to the provisions of 26 U.S.C. 7425(c) and Reg. 301.7425-1, and T.C.A. 50-7-404(i)(2)(B) and 67-1-1433(b)(2) and Rule 1320-2-1-.35, if applicable. The Property Is To Be Sold Without Covenants Or Warranties, Whether Express Or Implied, Including Without Limitation, Warranties Of Merchantability Or Fitness For A Particular Use Or Purpose. The following items recorded in said Register's Office may be adversely affected by the foreclosure sale: (1) Notice of Federal Tax Lien dated March 4, 2013, recorded March 11, 2013 in Book 1084, page 338, (2) Notice of Federal Tax Lien dated March 5, 2013, recorded March 11, 2013 in Book 1084, page 339, (3) Notice of Federal Tax Lien dated March 5, 2013, recorded March 11, 2013 in Book 1084, page 341, and (4) Notice of Lien of Mt. Zion CPA Solutions, P.C. dated August 8, 2016, recorded August 8, 2016 in Book 1207, page 556. Substitute Trustee, at his sole discretion, at the time and place appointed above for the sale, to accomplish the most advantageous sale and consequent discharge of the trust obligations under the circumstances, reserves the right to do any or all of the following: Postpone the sale of all or any portion of the property by public announcement at such time and place of sale, and from time to time thereafter postpone such sale by public announcement at the time fixed by the preceding postponement or subsequently noticed sale, and, without further notice, make such sale at the time and place fixed by the last postponement, or in their discretion, give a new notice of sale. Appoint an agent to sell the property in accordance with the power of sale contained in the Deed of Trust and to take other action which the Substitute Trustee may take thereunder. Elect to delay the sale for a reasonable time during regular business hours on the same day to be continued at the same place at the announced time in order to enable any bonafide bidder to determine and submit a bid, so long as no potential purchaser is thereby precluded from placing a bid. Elect to sell the property in any other manner or manners as may accomplish the most advantageous sale and consequent discharge of their trust obligations under the circumstances. The failure of the high bidder to close this sale shall be cause for rejection of the bid, and if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is capable and willing to comply with the terms thereof.
