TRUSTEE'S NOTICE OF SALE On the 21st day of November, 2017, JAMES SMITH and wife, APRIL SMITH, executed and delivered Deeds of Trust to Point & Keeton, P.C., Trustee, conveying the property in trust hereinafter described, which Deeds of Trust are of record in the Register's Office for Hawkins County, Tennessee, in Record Book 1255, page 509, and Record Book 1255, page 512. Said Deeds of Trust were delivered to secure notes owing Hawkins Habitat for Humanity, in the amount of $78,476.00 and $57,504.00. Default having been made in the payment of said indebtedness as provided in said notes and Deeds of Trust, the holder and owner of said note has declared the entire indebtedness due. The holder of the Note has instructed the undersigned Trustee to foreclose said Deeds of Trust in accordance with its terms: NOW, THEREFORE, pursuant to the power and title vested in the undersigned as Trustee, the undersigned will, on the 25th day of September, 2019, at 1:30 P.M. in front of the Courthouse door in Rogersville, Hawkins County, Tennessee, offer for sale and sell at public auction to the last, highest and best bidder, for cash in hand and in bar of the equitable and statutory right of redemption, and subject to any unpaid real property taxes; and subject to any applicable easements and restrictions or prior liens or mortgages, if any, the following described premises, to-wit: SITUATE in the Fourth Civil District of Hawkins County, Tennessee, lying on and to the South of Colonial Road, and being Tracts 4 and 5 on a map or plat drawn by C. Randall Orr, RLS #1616, Sneedville, Tennessee, 37869, entitled Survey for Stewart McDavid, being the subdivision of a portion of Tract "R" of Mrs. W. W. Stone's subdivision of Lands (Ref. #2) and being more particularly described as follows: BEGINNING at a point in the southern right-of-way line of Colonial Road at the common corner for Tracts 5 and 6 (said iron pin being 100 feet from the common corner of Tract 6 and the property retained by Fulkerson); thence leaving said road and with the division line between Tract 5 and 6, S 43 deg. 26 min. 59 sec. E, 200.00 feet to a point in the line of lands of Fulkerson; thence with the line of Fulkerson, S 46 deg. 33 min. 01 sec. W, 200.00 feet to a point in the line of Fulkerson and common corner for Tracts 3 and 4; thence with the division line between Tract 3 and Tract 4, N 43 deg. 26 min. 59 sec. W, 200.00 feet to a point in the southern right-of-way line of Colonial Road; thence with the line of said road, N 46 deg. 33 min. 01 sec. E, 200.00 feet to the point of BEGINNING, containing 0.918 acres, more or less. BEING the same property conveyed to James Smith and wife, April Smith, by Warranty Deed executed by Hawkins Habitat for Humanity, Inc., dated November 21, 2017, of record in the Register's Office of Hawkins County, Tennessee, in Record Book 1255, page 506. SUBJECT to Protective and Restrictive Covenants as contained in said Deed of record in Deed Book 443, page 463, said Register's Office of Hawkins County, Tennessee. Being Tax Parcel Identification No. 101-101-112.05 In the event the high bidder at the foreclosure sale should fail to comply with the submitted bid, the Trustee shall have the option to accept the next highest bid in which the bidder is able to comply or to re-advertise and sell at a later date.
