SUBSTITUTE TRUSTEE'S NOTICE OF SALE On the 6th day of October, 2017, BOBBY JOE COUCH (aka Bobby J. Couch) and TRACY L. COUCH, executed and delivered a Deed of Trust to Steve M. Waller, Trustee, conveying the property in trust hereinafter described, which Deed of Trust is of record in the Register's Office for Hawkins County, Tennessee, in Record Book 1251, page 137. Said Deed of Trust was delivered to secure a note owing First Community Bank of East Tennessee, in the amount of $65,650.00. Default having been made in the payment of said indebtedness as provided in said note and Deed of Trust, the holder and owner of said note has declared the entire indebtedness due. As provided in said Deed of Trust, the holder and owner of the Deed of Trust has elected to appoint a Substitute Trustee, and the Point & Keeton, P.C. was appointed Substitute Trustee by instrument of record in Record Book 1329, page 690, in the Register's Office for Hawkins County, Tennessee. The holder of the Note has instructed the undersigned Trustee to foreclose said Deed of Trust in accordance with its terms: NOW, THEREFORE, pursuant to the power and title vested in the undersigned as Trustee, the undersigned will, on the 8th day of January, 2020, at 1:30 P.M. in front of the Courthouse door in Rogersville, Hawkins County, Tennessee, offer for sale and sell at public auction to the last, highest and best bidder, for cash in hand and in bar of the equitable and statutory right of redemption, and subject to any unpaid real property taxes; and subject to any applicable easements and restrictions or prior liens or mortgages, if any, the following described premises, to-wit: SITUATE in the FIFTH Civil District of Hawkins County, Tennessee, and being more particularly described as follows, to-wit: BEGINNING at an IRO in the northerly sideline of Old Highway 11-W, corner for the premises herein described and property now or formerly of Clarence Conant; thence with the divisional line between premises herein described and property now or formerly of Clarence Conant, the following courses and distances, to-wit: N 29-14-00 W, 308.90 feet to an IRO, N 0-02-00 E, 122.39 feet to a post; and N 29-14-00 W, 449.95 feet to a post, corner for property now or formerly of James King; thence with the divisional line between the premises herein described and property now or formerly of James King, N 59-05 25 E, 199.53 feet to an IRO, corner for property now or formerly of James C. Noe; thence with the divisional line between premises herein described and property now or formerly of James C. Noe, S 29-23-00 E, 736.38 feet to an IRN, corner for premises herein described and property now or formerly of Charles C. Johnson and wife, Dorothy S. Johnson; thence with the divisional line between premises herein described and property now or formerly of Charles C. Johnson, the following courses and distances, to-wit: S 63-44-31 W, 200.19 feet to an IRN; and S 29-23-00 E, 141.22 feet to an IRN in the northerly sideline of Old Highway 11-W; thence along and upon said sideline of said Highway, S 56-49-33 W, 61.80 feet to the point of BEGINNING, containing 3.85 acres, more or less. BEING the same property conveyed to Bobby J. Couch by Clerk and Master's Deed dated June 27, 2001, of record in Deed Book 430, page 9, in the Register's Office of Hawkins County, Tennessee. Charles C. Johnson and wife, Dorothy S. Johnson, for themselves, their heirs and assigns, retain a 15-foot right-of-way for the purpose of ingress and egress over an existing driveway extending from Old Highway 11-W along and to the West of the westerly sideline of the property retained by Charles C. Johnson and wife, Dorothy S. Johnson, on a call of N 29-23-00 W, 141.22 feet. PREMISES also subject to a 14 foot right-of-way BEGINNING in the northern margin of Old Highway 11-W and proceeding northerly in parallel lines, N 29-24 W, 308.90 feet to an iron pin; N 00-02 E, 122.39 feet to a post and N 29-14 W, 374.43 feet to an iron pin, said right-of-way terminating at the northwestern edge of the above described property.
